CBIC Notification: Strict E-Invoicing Time Limits & Rule 37A ITC Reversal Protocols for Businesses

Published: January 14, 20256 min readEffective: Immediate Enforcement

Executive Regulatory Summary

CBIC enforcement guidelines regarding the 30-day time limit for reporting B2B invoices on the Invoice Registration Portal (IRP) for taxpayers with turnover exceeding ₹100 Crore, and mandatory reversal of Input Tax Credit (ITC) under Rule 37A where suppliers fail to file GSTR-3B.

Key Statutory Takeaways

  • Invoices older than 30 days cannot be uploaded to the IRP portal for businesses meeting threshold.
  • Input Tax Credit claimed in GSTR-3B must be reversed under Rule 37A if the corresponding supplier does not file GSTR-3B by November 30.
  • Automated automated GST mismatch notices via Form DRC-01B and DRC-01C.
  • Strict e-Way Bill integration with e-Invoice generation.

Actionable Compliance Checklist for Businesses

Step-by-step advisory measures prescribed by ASGR and CO for immediate adherence:

1Verify that ERP billing systems automatically push B2B invoices to IRP within the 30-day statutory window.
2Implement a monthly automated vendor compliance tracker to monitor vendor GSTR-3B return filings.
3Reconcile monthly GSTR-2B with purchase register before finalizing ITC in monthly Form GSTR-3B.
4Track and reverse ITC under Rule 37A on or before November 30 of the following financial year to prevent interest under Section 50.

1. 30-Day Window for E-Invoice Generation

The GST authority has implemented a strict validation rule on the Invoice Registration Portal (IRP). Taxpayers with aggregate annual turnover of ₹100 Crore and above cannot report invoices, credit notes, or debit notes beyond 30 days from the document date.

Invoices issued without a valid Invoice Reference Number (IRN) and QR code are treated as null and void under GST law, disentitling the recipient from claiming input tax credit.

2. Rule 37A: Buyer's Responsibility for Supplier's Non-Filing

Under Rule 37A of the CGST Rules, where input tax credit has been availed by a recipient on the basis of invoice reflected in GSTR-2B, but the supplier has not filed GSTR-3B by 30th September (extended to 30th November), the recipient must reverse such ITC.

Re-availment is allowed only when the supplier subsequently files their pending GSTR-3B and discharges the tax liability.
